BRGFA is an abbreviation for Brokenhead River Game & Fish Association and the terms may be used interchangeably.

Please read the following carefully. Refusing or declining the releases may cause your application to be denied.

OVERVIEW

My Brokenhead River Game and Fish Association membership may entitle myself and/or my family to make use of and/or observe activities on the shooting ranges of the Brokenhead River Game and Fish Association. The Brokenhead River Game and Fish Association and its representatives have taken all reasonable steps to ensure the safety of those who attend and use the shooting ranges and other facilities. There are inherent risks involved as set forth in the Statement of Risk (to follow). As a member I will need to release BRGFA from liability in the following ways.

STATEMENT OF RISK

I acknowledge and understand that shooting activities (use, close proximity, or observation of those using firearms or archery equipment) are inherently hazardous and involve both known and unanticipated risks which could result in bodily harm or death, damage or destruction of property, and/or emotional injury to myself or of other people.

I further acknowledge and understand that the nature and condition of the shooting range facilities, BRGFA premises, and environment is such that both known and unanticipated hazards exist outside the act of firearm use. These hazards include but are not limited to, slippery, loose, and/or falling soil and rocks; and unimproved, unmaintained or uneven terrain on walkways on steps and roads.

RELEASE OF LIABILITY

I agree to release all waiver and claims that I have or may have against Brokenhead River Game and Fish Association and its representatives and their respective servants, successors, assign, agents and employees.

I agree to release BRGFA and its representatives or volunteers from any and all claims, demands, damages, actions that may arise over loss, injury, damages (including death), and/or expenses that I may suffer as a result of my presence on the BRGFA shooting ranges, facilities, or property, and due to any cause.

I agree that I am in the proper physical and mental condition to attend and use BRGFA facilities including the shooting ranges, and to accept the risks set out herein and that if I am under the age of eighteen (18) years old, my parent or guardian as set forth below has reviewed this waiver and acknowledgement and has advised me or accepts responsibility for the risks involved.

INDEMNIFICATION

I agree to hold harmless and indemnify Brokenhead River Game and Fish Association from any and all liability for any loss damage, injury, or expenses to any third party resulting from the attendance at or use of the shooting ranges.

BINDING OF AGREEMENT & ACKNOWLEDGEMENT

I understand and accept that this agreement shall be effective and binding by heirs, executors, administrators, and/or assigns of those named in the membership application.

I confirm that I have read and understand these waivers and releases, and further acknowledge that I have read and understand the BRGFA constitution and bylaws.

PHOTO RELEASE

I grant BRGFA permission to use my likeness in photo, video, or other digital media (hereafter "photo") in any and all of its publications, including print and web-based, with out payment or other consideration. I understand that all photos will become the property of BRGFA and will not be given or returned. I irrevocably authorize BRGFA to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition I waive any right to inspect or approve the finished product wherein my likeness appears. I waive any right to royalties or other compensation arising from or related to the use of the photo.

I hold harmless, release, and forever discharge BRGFA from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or that of my estate may bring forward by reason of this authorization.

I have read and understand this release. I affirm that I am at least 18 years of age, and if signing on behalf of anyone under 18 that I am their legal parent or guardian.

*Note that refusal to agree with the photo release will not prevent a membership from being granted. In the case of refusal of the photo release. I do confirm, however, that it is my duty to inform any BRGFA representative upon arriving at a BRGFA event or other situation where my photo may be taken and used that I have refused the agreement and do not wish my photo to be used by BRGFA. BRGFA cannot be held responsible for the use of likeness captured by other members or event attendees for any purpose.
